In the event of any inconsistency between our terms and conditions and this privacy policy, this privacy policy takes precedence with regard to the collection, use, and disclosure of your personal information.

Please read this policy carefully. By using the Services, you confirm that you have read this privacy policy.

We are established in the Netherlands and sell to consumers in Australia. Although we are based overseas, we handle personal information of Australian customers in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), to the extent they apply to our activities.

What personal information do we collect?

When we use the term "personal information," we mean information that identifies you or from which your identity can reasonably be ascertained. Personal information does not include information that has been de-identified so that you can no longer be identified.

Depending on how you use the Services, we may collect the following categories:

  • Contact information – name, postal address, billing address, delivery address, phone number, and email address.
  • Payment information – payment card details, transaction information, payment method, and payment confirmation. We do not store full card numbers ourselves; these are handled by our payment processors.
  • Account information – username, password, and settings, if you create an account.
  • Transaction information – the items you view, add to your basket, purchase, return, exchange, or cancel, as well as your order history.
  • Sizing information – the measurements and size selections you enter into our size guide.
  • Communication with us – the information you provide when contacting customer service.
  • Device information – information about your device, browser, network connection, IP address, and other unique identifiers.
  • Usage data – how and when you use or visit the Services, including via cookies and similar technologies.

Where do we collect this information from?

  • Directly from you – when you create an account, place an order, contact us, or otherwise provide us with your information.
  • Automatically through the Services – from your device when you visit the website, via cookies and similar technologies.
  • From our suppliers – when they collect or handle personal information on our behalf.

What do we use your information for?

We collect, hold, use, and disclose personal information for purposes including:

  • Processing your order, completing payment, arranging delivery, and handling returns and exchanges.
  • Customer service and responding to your enquiries.
  • Bookkeeping and meeting our accounting and tax obligations.
  • Preventing fraud and keeping the Services secure.
  • Sending newsletters and marketing by email or SMS, where you have opted in.
  • Advertising and audience targeting on third-party platforms, where you have consented to marketing cookies.
  • Statistics and improving the website.

Where we rely on your consent (for example, for marketing communications or marketing cookies), you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of anything we did with your information before you withdrew consent.

Who do we disclose personal information to?

We disclose personal information to suppliers who handle information on our behalf, as well as to independent third parties where necessary. This includes:

  • Shopify – hosting the webshop, order management, and payment processing.
  • CheckyPro – external checkout solution. When you complete a purchase via this checkout, your contact, delivery, and payment information is processed there.
  • Kaching Cart – shopping basket functionality on the website.
  • Klaviyo – email marketing and newsletters, including sending and statistics.
  • KiwiSizing – size guide and size recommendations.
  • Meta (Facebook/Instagram) – advertising and ad performance measurement via Meta Pixel and similar technologies.
  • Google – statistics and advertising via Google Analytics and Google Ads.
  • Couriers – delivery of your order.

We may also disclose personal information where necessary to comply with the law, respond to requests from authorities, enforce our terms, or protect our rights or those of others. In the event of a business transfer, merger, or insolvency, information may be included among the assets transferred.

Our marketing and analytics partners handle information in accordance with their own privacy policies.

Overseas disclosure

Several of the suppliers listed above are located, or store and process data, outside Australia — including in the Netherlands (where we are based), the United States, and other jurisdictions where our service providers operate (for example, Shopify, Meta, and Google). Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, including through contractual protections where applicable. By using the Services, you acknowledge that your information may be handled outside Australia and that, in some circumstances, we may not be able to ensure an overseas recipient complies with the APPs.

Our relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you provide to the Services is shared with Shopify and with third parties who may be located in countries other than Australia.

Shopify also uses certain features that rely on data from your interactions with our store, other retailers, and Shopify. In these cases, Shopify is itself responsible for that processing. You can read more in Shopify's privacy policy at privacy.shopify.com.

Cookies

We use cookies and similar technologies on the website. Necessary cookies are set for the website to function, including the shopping basket and checkout. Statistics and marketing cookies (including Meta Pixel and Google Analytics/Ads) are only set with your consent, which you can give or withdraw via the cookie settings on the website.

You can also delete cookies at any time in your browser settings.

Third-party websites and links

The Services may contain links to websites or platforms operated by third parties. We are not responsible for the content, privacy practices, or security of these websites. We recommend that you read their privacy policies. Linking to them does not imply that we endorse their content.

Children's information

The Services are not directed at children, and we do not knowingly collect personal information from children without appropriate consent. If you are a parent or guardian of a child who has provided us with personal information, please contact us at support@bellarashop.com to request that the information be deleted.

Retention and security

We only retain your personal information for as long as necessary for the purposes for which it was collected, or as required by law:

  • Order and accounting information is retained for the period required by applicable accounting and tax legislation.
  • Account information is retained for as long as you have an active account.
  • Marketing consent and newsletter data is retained until you withdraw your consent.
  • Customer service correspondence is retained for as long as relevant to the matter and any subsequent claims.

We take reasonable technical and organisational steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. However, no security measure is completely foolproof, and we cannot guarantee absolute security. We recommend that you do not send sensitive information to us via unsecured channels.

Your rights

You may have the following rights in relation to your personal information, subject to certain exceptions:

  • Access – you can ask what personal information we hold about you and request a copy.
  • Correction – you can ask us to correct inaccurate or out-of-date information.
  • Deletion – in certain circumstances, you can ask us to delete information about you.
  • Objection – you can object to certain uses of your information, and you can always opt out of direct marketing.
  • Withdrawal of consent – you can withdraw consent for marketing or marketing cookies at any time, without affecting the lawfulness of processing carried out before withdrawal.

You can exercise these rights by writing to support@bellarashop.com. We may ask you to verify your identity before actioning the request. We will respond as soon as possible, and in any case within a reasonable time.

Opting out of marketing: You can unsubscribe from newsletters at any time via the unsubscribe link in our emails. Even if you opt out of marketing, we may still send you service messages about your order or account.

Complaints

If you are unhappy with how we handle your personal information, please contact us first at support@bellarashop.com so we can try to resolve it directly.

If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
